The sources of building liability insurance policies are any number of insurers that offer policies for contractors, including standard construction insurance and specialty liability insurance. Different insurers will require different kinds of documentation to issue a policy, so it is important to do your research before settling on an insurer.

Claims on this type of policy can include worker’s compensation, bodily injury or property damage. Most insurances companies require the contractor prove they have appropriate general liability coverage in place with limits up to $500,000 per occurrence/$500k annual aggregate for each area - such as workers’ compensation and general commercial liability. Some companies will also require professional liability and public liability insurance as well. Some specialty insurances may even require workers’ compensation or auto insurance, and some insurances companies may even require 100% Property Damage Liability (PDL) coverage as part of their policies.

When pursuing a claim, the contractor may need to go to divisional court, which is essentially like a civil court for this type of policy. There are many different types of divisional courts that govern certain circumstances, but in general the contractor will be trying cases on whether or not their insurance is sufficient to cover the damages that accrue from the work performed.
