When an application for a Worker's Compensation Claim goes into litigation, the onus rests on the staff's lawyers to try and win the claim for the staff. Sometimes, even when the claims are genuine and the attorney has tried everything to win the claim, it just can't work. This is because the staff had already made mistakes that truncate the efforts of the attorney. Here are some common mistakes made by injured staff that make Workers' Compensation claims hard to win.

1) Not informing his/ her doctor that the injury is from work: Sometimes, the employer might convince the injured staff not to disclose the source of the injury, and the staff obliges. When the staff obliges and hides the source of his injury from the doctor, it is documented, and when taken to court gives the insurance company an advantage.

2) Not submitting to the insurance company's doctor: Whatever an external doctor recommends for injured staff, the insurance company can assert that it is false. So, the injured staff has to submit to their doctor rather than refuse totally. He can ask for an optional doctor but it is important to see their doctor. Else they would say in court, that you rejected proper medical treatment.
