Veterans are often exempt from taxes, and in the United States, there are even tax exemptions for veterans that vary by state. For example, in Virginia, Veterans Affairs benefits are not taxable. But does this exemption extend to all Commonwealth of Virginia veterans?

No, only those receiving a pension. In this article, we will explore why this is, and see what other exemptions are extended to Virginia veterans in the state.

How Does Virginia Deal With Income Tax Exemptions For Veterans?
In general, each state in the United States has its own set of rules regarding taxation and veterans. However, there are some similarities between the various states. For example, if you are a resident of the United States and you have served in active duty for any branch of the military or another exempt organization (such as Public Health Service), then you are often eligible for an exemption from paying income tax to that specific state. Other states generally do the same.

How Are Virginia's Tax Laws Relating To Veterans?
In Virginia, the state has a section of code related to income tax exemptions for military members. This is found under Title 58 Section 56-95.01, which is titled "Income Tax Exemptions."

Veterans are exempt from paying state income tax in Virginia.

A veteran is any person who served on active duty, including members of the National Guard, for at least 181 days during a wartime period and received an honorable discharge or was released under Public Law 85-86 (conditional release). Active duty service includes training and full-time duty with a Reserve component that qualifies as active duty. All other personnel are not considered veterans.

In order to claim the exemption, you must file a VA-40 “Exemption for Veteran’s Exemption” form with your county revenue office and keep it in your possession. You can also download this form from the Virginia Department of Taxation website.
